HC directive instructs govt to finalize Hindi teachers appointment

IMPHAL July 27: The Guahati High Court, Imphal bench has today directed the state government to finalize the matter relating to the selection of candidates for the post of primary teachers, Hindi primary teachers and Hindi graduate teachers initiated vide employment notice dated 12/09/2006 issued by the employment exchanges, government of Manipur within a stipulated period of three months from the date of the passing of the high court order which is today.

A press conference was held relating to this at the office chamber of A. Jagjit advocate, who appeared on behalf of the writ petitioners namely the DPC faced candidate’s association for primary teachers, Hindi primary teachers and Hindi graduate teachers of 2006 represented by one Thingbaijam Subashchandra and 60 others, at his Uripok chamber.

Addressing media persons Jagjit mentioned that the writ petition filed by the association against the government of Manipur which is represented by the chief secretary as respondent no.1, commissioner education (s) as respondent no.2, commissioner MAHUD and revenue as respondent no. 3 and director education (s) as respondent no. 4, has asked for a directive to the respondent authorities to finalize the process initiated by declaring the pending non declaration of the written test result that was held on December 22, 2006 for the selection of primary , Hindi primary and  Hindi graduate teachers.

He further explained that, the representatives of the state government responded by filing its affidavit-in-opposition in reply to the allegation or argument  made in aforementioned writ petition stating that the government of Manipur had received certain complaints relating to the irregularities committed in conducting such written test in the education department, and as such a committee headed by the chief secretary was constituted on June 27, 2010 to look into such irregularities as well as into an unofficial publication of a DPC result in local daily newspaper and thereafter the report of the said committee was placed before the cabinet on September 22, 2010.

It has further been contended that the cabinet on that date took a decision to get a report from the concerned department apart from the law department and the advocate general and accordingly those reports were again placed before the cabinet on December 16, 2010, when a decision was taken to constitute a review DPC (which ought to have been the review selection committee) for considering of the entire matter, consisting of the director of education (S), as the chairman and two additional directors and the additional secretary of a department as members.

Further according to the counsel, the Guahati HC directive has further stated that the counsel for the petitioners considering the assertion made in the affidavit in opposition asked for disposing of the writ petition with the direction to the respondents to finalize the matter relating to the selection of candidates for the aforesaid posts pursuant to the aforesaid employment notice September 12, 2006 within a fixed period of time.

The writ petitioners are given the liberty to approach the court again, if any adverse decision is taken against them.

Later during the conference, Jugjit while citing irregularities and non-compliance of official orders by the government said that as per official memorandum issued by the government of Manipur on many occasion since February 1991, it is stated that the DPC of class III and classs IV should be declared immediately whereas the written test for the primary teachers, Hindi primary teachers and Hindi graduate teachers of 2006 was held on December 22, 2006.
