IMPHAL, December 31: The Human Rights Law Network has notified that as per an order dated 29th December 2012 passed by the Chief Judicial Magistrate, Thoubal which had ended putting a survivor of rape in the custody of the Investigating Officer of Thoubal Police Station has now been set aside consequent upon a Criminal Revision filed today before the Sessions Judge, Manipur West.
The Hon`ble Session Judge, Manipur West has observed that the Chief Judicial magistrate, Thoubal has committed error in passing the said order for keeping the victim girl in the custody of the Investigating Officer since the victim of any crime cannot be kept in police custody for any reason whatsoever.
The Court has warned the concerned Investigating Officer to strictly follow the procedure of the investigation prescribed under the Cr.P.C. Following a plea by a team of HRLN advocates for setting aside the order of the Chief Judicial Magistrate, Thoubal in the Court of Sessions Judge, Manipur West the Court has set aside the order of the Chief Judicial Magistrate, Thoubal.
After getting the order of the Sessions Judge, Manipur West, a team of the HRLN Advocates along with the husband of the survivor of rape went to the Thoubal Police Station and secured the release of the woman who was being held in police custody.
