Session Judge rejects anticipatory bail of rape accused

IMPHAL, August 23: An accused arrested in connection with the rape of a girl hailing from Kwakta ward number 2, under Moirang police Bishupur district has been remanded to judicial custody.

The accused has been identified as Phundreimayum Thoiba alias Thoi (25), son of Md Gaya alias Gayazuddin of Kwakta ward number 8.

The alleged rape incident occurred on November 3, 2012 at around 7:30 pm at the residence of the girl who was alone as her family members had gone out to attend a marriage ceremony.

Even though the accused was apprehended by the locals the same day of the crime, he has reportedly remained at large till date.

The recorded statement of the girl`s party has also accused the Kwakta Nagar Panchayat ward number 2 councillor for setting the accused free.

The statement said that after the accused was apprehended by the locals, the councillor intervened and insisted them to hand over the accused to him. The councillor promised that the accused will be handed over to the Moirang police the next morning, said the report.

The next day the councillor allegedly set the accused free without the consent of the victim’s party, it said.

On November 5, 2012, a complaint was lodge by the victim at the concerned police station in connection with the rape incident.

To the dismay of the victim, the police took up a case with regard to the complaint on the third day after the complaint was lodged (FIR No. 112(11)2012 Moirang PS U/S 376/447/323/406/417/34 IPC).

Subsequently, a medical examination was conducted on the victim on November 9, 2012.

While, the additional sessions judge (fast track court), Manipur West on January 31, 2013 granted anticipatory bail to the accused,  a petition challenging the anticipatory bail granted by the Sessions Judge was filed at the High Court of Manipur.

On July 17, 2013, after admitting the petition, the High Court issued an order to the Additional Sessions Judge, to re-consider the anticipatory bail after producing the case diary.

The same bail was rejected by the Sessions Judge on July 25, 2013 and instructed the IO of the case to take swift action.

In the back drop of the court’s instruction and with no visible action in sight, an application was filed to the SP Bishnupur on August 3, 2013, seeking the transfer of the case to other police station from the Moirang Police.

Subsequent upon the application, the Session Judge remanded the accused to judicial remand.
