AR N/SUB serves legal notice to DGAR, Meghalaya

IMPHAL, August 9: A junior commissioned officer, JCO, of the 30th Assam Rifles Ramesh Chand Sharma has served a legal notice to the Director General Assam Rifles, Meghalaya and the Commandant of the 30th Assam Rifles for immediate action to promote him to Sub (GD).

Acting on behalf of Ramesh Chand, his counsel Wati Jamir served the legal notice seeking immediate necessary steps to be taken to promote the L Naib to the post of Subedar with retrospective effect from the date of promotion of his juniors to the said post.

It has also demanded that the promotion should be with all consequential benefits and be taken up within a period of one month.

Failing compliance with the demands, the notice has threatened legal steps against the two.

It said Ramesh Chand was informed in a letter dated August 19, 2005 that his case cannot be considered for promotion to the post of Nb/Sub on the ground that he was placed in Low medical Category, although most of his juniors have been promoted way back in 2004.

Ramesh Chand had filed a writ petition before the Gauhati High Court, challenging the legality of the letter following which the court had quash the letter with direction to the authorities to consider his case for promotion.

The Union of India and Assam Rifles authorities in a counter against the judgement filed a writ appeal (W.A No.11 (K)/2010, before the appellate court. But, the appeal was dismissed by the High Court on August 2, 2011 while upholding the previous judgement.

Subsequently, Ramesh Chand filed a contempt petition (Civil Organisation Contempt No. 35(K)/2011). However, during the pendency of the contempt, Ramesh Chand was promoted to his due post of Naib Subedar on May 8, 2012.

Against this backdrop, four of Ramesh Chand’s junior identified as Chanchal Singh, Mangal Singh, PD Barman and RS Chandal were promoted to the rank of Subedar.
