HC stays Prithiviraj disqualification verdict

IMPHAL, March 2: The High Court of Manipur has today stayed its earlier order disqualifying Moirang MLA Mairembam Prithiviraj’s membership for a period of four weeks starting today.

A single bench of Justice N Kotishwar of the High Court of Manipur on February 29 had passed a judgement in Election Petition No 1 of 2012 filed by P Sharatchandra as election petitioner that the election of 27 Moirang Assembly Constituency MLA Prithiviraj is void under Section 100(1)(d)(i) of the Representation of the People Act, 1951.

Today, the court has stayed its February 29 judgement in the case charging Pritihiviraj of wrongly filing his highest educational qualification as MBA passed out from Mysore University in his election affidavit for the 10th Manipur Legislative Assembly Election, 2012.

Speaking to media persons during a press conference held at the Manipur Press Club, Prithiviraj’s junior counsel advocate Sagolsem Poireiton said Prithiviraj had submitted an appeal before the Supreme Court on March 1 against the High Court’s February 29 judgement and had accordingly prayed before the court for passing an order for staying the operating of the February 29 order under section 11B of the Representation of the People Act, 1951.

Today, after the High Court considered all the facts and circumstances of the case as mentioned by the counsels of both the petitioner and the respondent had stayed its earlier order for a period of four weeks, he told the media persons.

He also said that they are yet to get a certified copy of the order of the High Court of Manipur.

According to the advocate, Prithiviraj had pursued PG in Service Industry management in 2004 from Chandigarh.
