Commission refutes affidavit of OC John

IMPHAL, March 5: An affidavit filed by P John Singh, Officer-in-charge of Commando Imphal West District in response to the application filed by one Nameirakpam (O) Seram (N) Lembi Leima wife of Nameirakpam Basanta Singh of Bashikhong Mamang Leikai was refuted by the Supreme Court appointed Commission today stating that it is a direct contempt to the Commission.

The third day sitting of the Commission was conducted from 8:30am to 8:45pm.

In the affidavit, the deponent stated that on March 3, 2013 at about 3 pm, acting on a credible information about the presence of some banned cadres of KCP at Bashikhong area, he along with his team had gone to the said area for verification and also area domination.

John said that during the course of patrolling, he had gone inside the house of Nameirakpam Somorendro alias Bogra son of N Basanta Singh of Bashikhong Mamang Leikai who is said to be a member of banned KCP. 

He continued that after meeting the family members and the mother of Somorendro, it was revealed that the said Nameirakpam Somorendro is an active member of banned KCP (MC), now reportedly staying at the designated camp of KCP (Lalumba faction) located at 7th Battalion Manipur Rifles, Imphal East, Khabeisoi.

He mentioned further that the deceased Nobo Singh was the elder brother of Somorendro Singh and thereafter, he came back from the said place.

Denying the allegation that he offered a job to Somorendro, as alleged, John said he apologized for any misunderstanding being created.

The Chairperson of the Commission after hearing out John remarked that the audacity of this person (John) shows how the state functions.

It may be mentioned that the case of Nobo (27) who was allegedly killed in Imphal West after being picked up by a combined team of the police and Assam Rifles from Imphal East on April 4, 2009 is also being heard by the Commission as part of its inquiry.

In the today’s proceedings two other cases were taken up namely Case No. 1 being the death of Md Azad Khan and Case No. 2 being the death of Khumbongmayum Orsonjit Singh.

In regard to Case No. 1, an application was being made by the petitioner because of the controversy of the visibility of the place of incident especially from the window from the house of Md Wahid Ali. The representative for Manipur Police said that they have also photographs which depicts a different picture.

The commission decides without getting into legality of the dispute and to know the ground reality  to appoint a committee to assess the ground situation with reference to the photographs.

A three member committee under the leadership of Raeesa Vakil, Advocate along with Seityandra and Shyam Sharma, Advocates will visit the place in question and report to the commission by 1 pm tomorrow.

Five witnesses of Case No. 1 namely Bronson Thanga, Havildar IRB; Civilian Mohd Itombi; Takhelmayum Pralhaja Singh, the then IO of the case and the then OC of Lamsang Police Station P Suresh Meetei, 2nd OC of Lamsang Police Station; RK Anilkumar, present IO of the case; and two witnesses of Case No. 2 namely Premkumar Singh, Havildar 6th Bn Manipur Rifles; Moirangthem Khogen Singh, Inspector (CID-Crime Branch) were produced before the Commission today.  

When asked about the word ‘exit wound’ on the inquest report of death of Md Azad Khan, Takhelmayum Pralhaja Singh replied that it is a mistake and said that he forgot to mention the injury on the left arm.

The Supreme Court appointed Commission to investigate six fake encounter started its sproceedings from Sunday and has retired Justice Santosh Hegdre as Chairperson with former Director General Police of Karnataka Ajay Kumar and former Chief Election Commissioner (Election Commission of India) JM Lyngdoh as members.
