Centre directed to submit amended affidavit in forced retirement petition

IMPHAL, July 2: A single bench of Justice N Kotishwar, High Court of Manipur has directed the Union of India, DG Assam Rifles to submit amended counter affidavits in connection with a petition filed by a naib subedar challenging a forced retirement notification served against him.

The petitioner has been identified as Rameshchand Sharma, 52, son of Wadhoram Sharma of Jindwin Village, Himachal Pradesh, naib subedar in 20th Assam Rifles.

The secretary of Ministry of Home Affairs will respond on behalf of Union of India in the case which has the commandant 30th Assam Rifles c/o 99 APO as the third respondent.

Rameshchand Sharma had filed writ petition (c) no 50 of 2013 with the then Gauhati High Court, Imphal Bench challenging the validity of the compulsory retirement order dated October 26, 2012 issued by the captain SO-3(Coord) for DGAR, Shillong thereby forcing him to retire from service on the forenoon of March 1, 2013.

He pleaded that the order was not sustainable in the eye of law and also allowed to continue in service till he attained the age of superannuation.

In response to the petition, the court gave adequate time to the respondents to file their respective counter affidavit which they did eventually.

However, not satisfied with the affidavit of the respondents the court gave the direction today.
