Chargesheet filed in case of encounter of Sanjit Meitei in Imphal, Manipur

CBI has filed Chargesheet today in the Court of Chief Judicial Magistrate, Imphal against the Commandos of Manipur Police and the then OC of City PS Imphal viz. Inspr. Munal Singh, Inspr. H. Devendra Singh, HC Thounaojam Herojit Singh, Rfn Ngangom Toyaima Singh, Const.W.Binoy Kumar Singh, Hvl. Th. Jagat Singh, Rfn. Md. Imran Khan, HC Oinam Keshor Singh and Const. Makan Kanchung Chothi under various sections of IPC in connection with B.T.Road firing incident of 23.7.2009. Accused persons have been chargesheeted U/s.34 r/w 302, 218, 203 IPC and also under substantive offcences. The Court of CJM, Imphal has taken cognizance of the Chargesheet and issued warrant of arrest against the accused persons.
In Writ Petition (Crl.) No. 77/2009 filed by Smt. Chungkham Taratombi Devi, mother of deceased Chungkham Sanjit Meitei, the Hon’ble Guwahati High Court, Imphal Bench passed an order dated 25.08.2009 to treat the complaint dated 07.08.2009 of the mother as FIR, following which City PS Imphal(W) registered FIR dated 26.8.2009 U/s 302/34 IPC and Section 27(3) Arms Act. She alleged in the complaint that her son was shot dead arbitrarily by the Manipur Police Commandos. The Hon’ble Guwahati High Court-Imphal Bench vide its order dt.23.12.09 transferred the investigation of FIR of City PS Imphal(W) to the Central Bureau of Investigation.
As per the Manipur Police version, FIR was lodged in the City PS against an unknown youth (later identified as Sanjit Meitei) on 23.07.2009, who was allegedly shot dead in retaliatory firing by Police Commandos, on BT Road.
Pursuant to the High Court orders, CBI registered a Case against some personnel of Manipur Police Commando on 16.01.2010 corresponding to FIR of City PS. However, during the investigation, another case was also registered by CBI, corresponding to Manipur city PS case.
Investigation disclosed that on 23.7.09, the Manipur police commandos were doing their routine frisking on B.T.Road and then came across one youth who fired at them and ran towards the east and mingled with the crowd. The police also fired on the youth in retaliation. In the firing incident, five persons were injured and one pregnant woman was also killed. Police cordoned the area and started search operations. Sanjit Meitei who was present on B.T.Road was picked up by police, and taken inside the store room of Social Time Emporium/Maimu Pharmacy. He was not armed at that time and was accosted by the commandos and shot dead by them and a pistol was shown falsely recovered from him. Investigation revealed that there was no such pistol in possession of Sanjit Meitei and police planted the same after it was picked up from nearby GSS Arcade, minutes before the encounter.
CBI has cited over 250 witnesses and more than 125 documents besides several articles alongwith the charge sheet.
