Commission directs Director, Education (S) to compensate ex-MLA

IMPHAL, March 1: Manipur Information Commission has directed the Director of Education (S) to compensate ex-MLA of Uripok Constituency N Nodiachand Singh a sum of Rs 3000 within one month for the loss and detriment suffered due to failure of SPIO/Addl Director of Education (S) (Valley) to provide point wise information as per the RTI applications filed by the ex-MLA.

The commission also directed the SPIO to provide point wise information on the two RTI applications based on all available records to the appellant within one week from the date of receipt of the order.

The ex-MLA had filed two analogous appeal cases (Appeal Case No 70 of 2015 and Appeal Case No 71 of 2015) in the commission against the SPIO/Addl Director of Education (S) (Valley) and FAA/Director of Education (S) for non-disposal of his RTI applications on June 20, 2015 and September 7 and first appeal on October 26 and November 2 of the year wherein the appellant had sought the inspection reports by the ZEO, Zone I in respect of government aided Thambaljao High School and Sakhi Devi Girls’ High School for the years from March 1, 2003 to March 1, 2015.

It may be mentioned that Thambaljao High School and Sakhi Devi Girls’ High School were founded by the ex-MLA in 1972.

In the Appeal Case No 71 of 2015, the appellant sought the names of the president and the secretary with resolution copy signed by the approved Committee members to have been elected/nominated the president and the secretary in the constituted Committee No 6/13/96-ED(ZEO/Z-I) Aided, Imphal, September 14, 2010.

It also sought the resolution copy and appointment order copy in connection witht he appointed two teachers N Mangolnganbi Devi and W Nalini Devi of Sakhi Devi Girls’ High School at Uripok.

Upon hearing both parties on February 16 last and also as prayed by the representative of the SPIO for extension of time for providing information to the appellant as a last chance, the Commission had directed the SPIO to provide point wise information based on all available records to the appellant within one week from the date of receipt of the order vide Commission’s decision on February 16.

The representatives of the SPIO furnished written submission of the SPIO on February 25 and stated that the SPIO/Addl Director of Education (S) furnished all the available documents to the RTI applicant on February 20.

The appellant in his written reply on February 25 submitted that the information furnished by the SPIO is incorrect, misleading and incomplete. He further requested the commission to compensate him under Section 19 (8) (b) of the RTI Act for the detriment caused to him.
